Terms of Service

This policy outlines the conditions of service to our customers regardless of the location the service is delivered from. By using our services, you agree to these Terms of Service.

Refusal of Service

We reserve the right to refuse service to individuals who have previously violated our policies, including those who have been blacklisted for breach of contract or misuse of our services. Any such action will be taken in accordance with applicable laws, ensuring fairness and proportionality.

Free Services

Free services are limited to one per customer and are subject to availability. YourGameHost reserves the right to withdraw, modify, or impose additional restrictions on free services at its sole discretion.

Billing

Every month, on the service anniversary, we will either:

• • Debit the client's card (when such information has been provided to us during sign-up);
• • Debit the client's PayPal account using an automatic subscription (when such agreement has been configured by the client at checkout);
• • Send the client, by email or postal mail, an invoice in accordance with the next billing period.

Clients will receive an invoice every month for the billing period. Payment must be made no later than the due date printed on the invoice. YourGameHost reserves the right to suspend services for non-payment, providing notification before such action. Clients must ensure sufficient funds are available for automatic billing. Failure to pay within 7 days of the due date may result in service suspension.

Service Fees

All service fees, including setup fees where applicable, will be disclosed during the ordering process. YourGameHost does not offer prorated refunds for early termination unless otherwise stated.

Services are billed on a monthly basis, and the client will be responsible for all fees incurred during the billing period, regardless of termination notice. For example, if a client provides termination notice on the 15th day of the month, the client is responsible for all fees during that month.

Account Credit

Account credits can only be traded for YourGameHost products directly. Credits cannot be traded externally; if found to be trading such credit, it will be removed without warning.

Refunds

Refunds are subject to review and will only be issued in accordance with our policies. Clients must contact support to resolve disputes before initiating a PayPal claim. YourGameHost reserves the right to deny refunds for unauthorised claims.

All clients are eligible for refunds within the first 7 days of purchase. No refunds will be given for non-cancelled recurring payments made through a PayPal subscription, as it is the client's responsibility to ensure proper termination.

Refunds will not be issued for partially used services or where a violation of the Acceptable Use Policy (AUP) has occurred. In such cases, any and all refunds are forfeit. YourGameHost reserves the right to withhold a transaction fee of up to 3.5% + 30p on routine transactions.

Managed Server clients are not eligible for refunds.

Cancellations

To cancel a service, clients must submit a request:

• • At least 72 hours before the next billing cycle for monthly services; or
• • At least 15 days before the renewal date for quarterly, semi-annual, or annual services.

Clients must have all account information available to cancel, and outstanding fees must be settled prior to cancellation.

Liability

YourGameHost shall not be liable for incidental or consequential damages arising from service downtime, except where such downtime is caused by negligence. Liability is limited to the value of the affected service for the billing period in which the issue occurred.

It is the client's responsibility to ensure they have restorable backups within our panel. YourGameHost only takes backups of data required to restore access to services.

Violations

Any server found in violation of our Acceptable Use Policy (AUP) should be reported via a support ticket through the YourGameHost client portal or Discord support channels. All complaints will be investigated promptly. Failure to follow our ToS or AUP will result in suspension, termination, or both without refund.

Privacy and Data Protection

YourGameHost will process personal data in accordance with its Privacy Policy and applicable data protection laws, including the UK GDPR. By using our services, you consent to such processing.

Changes to the ToS

YourGameHost reserves the right to update this ToS. Clients will be notified of significant changes at least 30 days in advance. Continued use of our services constitutes acceptance of the updated terms. If you do not agree to the changes, you may terminate your service before the effective date.

Jurisdiction

This agreement is governed by the laws of England and Wales. Any disputes shall be resolved in the courts of England and Wales.

Consumer Rights

Nothing in this agreement affects your statutory rights as a consumer under the Consumer Rights Act 2015.
